2. Definitions

• Platform: The cloud-based software of Linqed.io, available through linqed.io and its subdomains.
• User: Any natural person or legal entity that uses the Platform.
• Agency: A marketing agency or organization that uses the Platform for LinkedIn strategy on behalf of its clients.
• Account: Personal or business access to the Platform after registration.
• Services: All functionality offered through the Platform, including LinkedIn strategy, campaign management, lead management and CRM integrations.

3. Applicability

These terms and conditions apply to every use of the Platform, to every agreement between Linqed.io and the User, and to all services offered by Linqed.io.

By creating an Account or using the Platform, the User agrees to these terms. Deviations from these terms are only valid when agreed in writing.

4. Our services

Linqed.io provides a cloud-based platform that lets agencies and organizations professionalize their LinkedIn strategy. The Platform offers, among other things:

• Smart networking and campaign management
• AI-driven lead management and sentiment analysis
• CRM functionality with pipeline visualization
• Multi-channel communication (LinkedIn and email)
• White-label options for agencies
• Reporting and analytics

Linqed.io reserves the right to change, expand or limit the range of Services.

5. Account registration & access

To use the Platform, the User must create an Account. The User is responsible for:

• Providing correct and current information at registration
• Keeping login details confidential
• All activity under their own Account
• Reporting unauthorized use of the Account immediately

Linqed.io reserves the right to refuse, suspend or terminate Accounts in case of misuse or a breach of these terms.

6. Use of the Platform

The User agrees to use the Platform only in line with these terms and with applicable laws and regulations.

The User is not allowed to:

• Use the Platform to send spam or unwanted messages
• Use the Platform for misleading, fraudulent or unlawful purposes
• Circumvent or disrupt the technical security of the Platform
• Collect data from other Users without their permission

Linqed.io monitors use of the Platform and can suspend or terminate the Account in case of a violation, without a refund.

7. Payment terms

• The rates for using the Platform are communicated in advance and are available on the website or in a quote.
• Invoicing is monthly or yearly in advance, depending on the chosen subscription.
• Payment is due within 14 days of the invoice date, unless agreed otherwise.
• If payment is late, Linqed.io reserves the right to suspend access to the Platform.
• All prices quoted exclude VAT, unless stated otherwise.
• Linqed.io reserves the right to change its rates and announces any change at least 30 days in advance.

8. Intellectual property

All intellectual property rights to the Platform, the software, the website and the related documentation belong to Linqed.io (BlinktUit). This includes, among other things, copyright, trademark rights, database rights and patent rights.

The User is not allowed to copy, modify, distribute, reverse-engineer or otherwise exploit the Platform or parts of it without prior written permission from Linqed.io.

9. Liability

Linqed.io works to keep the Platform running properly, but gives no guarantees about its availability, completeness or suitability for a particular purpose.

Linqed.io's liability is limited to the amount the User paid to Linqed.io for use of the Platform in the past 3 months.

Linqed.io is not liable for indirect damage, consequential damage, lost profits, lost savings or damage caused by restrictions, changes or measures taken by external platforms or third-party services.

10. Privacy

Linqed.io handles personal data with care. Data is hosted on EU servers in Belgium. For more information about how we handle personal data, see our Privacy Policy.

11. Availability & maintenance

Linqed.io aims for the highest possible availability of the Platform, but does not guarantee uninterrupted access.

Linqed.io is entitled to take the Platform out of service temporarily for maintenance, updates or improvements. Planned maintenance is announced in advance where possible. Linqed.io is not liable for damage caused by (temporary) unavailability of the Platform.

12. Termination

The User can cancel the subscription at any time through the Platform or by contacting Linqed.io. The cancellation takes effect at the end of the current billing period.

Linqed.io can end the agreement with immediate effect if the User acts in breach of these terms or the law.

After termination, Linqed.io keeps Account data in line with the retention policy in the Privacy Policy and deletes it afterwards.

13. Changes to these terms

Linqed.io reserves the right to change these terms and conditions. Changes are announced by email or through the Platform at least 30 days before they take effect.

If the User keeps using the Platform after a change, this counts as acceptance of the new terms. If the User objects, they can cancel the subscription before the changes take effect.

14. Governing law

These terms and conditions and all agreements between Linqed.io and the User are governed by Dutch law.

The parties settle disputes by mutual agreement where possible. If that does not work, the dispute is brought before the competent court in The Hague, the Netherlands.
